Understanding What A Power Of Attorney Does

A power of attorney (POA) is a legal document that allows one person – the principal – to authorize another – the agent or attorney-in-fact – to act on their behalf. This authority can be broad or limited. It can become especially important during times of illness, incapacity or extended absence.

Under Florida law, a POA is only valid if the principal signs it in the presence of two witnesses and a notary public. The agent they appoint must be at least 18 years old or a qualified financial institution.

There are several types of POAs you can create:

  • Financial POA: Grants the agent authority to manage financial matters such as banking, investments, real estate and bill payments
  • Health care POA: Often part of an advance directive, it authorizes the agent to make medical decisions on your behalf, ensuring your health care preferences are followed if you become incapacitated
  • Limited (or Special) Power of Attorney: Grants the agent authority to perform specific tasks, such as signing documents for a real estate closing or managing a single financial transaction, usually for a defined period or purpose

It’s important to note that, in Florida, not all POAs remain valid if the principal becomes incapacitated. Unless the POA is “durable,” the agent loses all authority to act when the principal may need help the most.
